Planetary Constitution

We the people of the planet Earth, in order to form a sustainable union for the long term preservation of our species, do ordain and establish this Constitution for the planet.

Premises
The purpose of the Planetary Government is to establish laws and order that will allow the human species to survive on our planet Earth until unforseeable natural events terminate that possibility.

During the foreseeable future, the following goals exist:

1)  Reduce the human population to a sustainable level, with an empahsis on quality of life over quantity of life.  Explicitly, methods must be employed to decrease the population of the planet, starting immediately, using humane methods such as birth control, sex education, and perhaps incentives to not have children.

2)  Return large portions of the planet to nature, instituting laws that forbid human activity on sizable, contiguous, portions of our biosphere.  This reflects an understanding that as a species we have a right to  live  - but so does the other life on the planet, with at least sizable portions of their population undisturbed by humans.

End game:  Peaceful coesistance with a diverse species of life on our planet and eventually, spreading of human life beyond our planet as the only way to ensure our species survival.

Article 1 - Legislative
Planetary Congress consisting of a Senate and House of Representatives.

Each member nation shall be allowed 2 Senators and 4 Representative.

Each Senator shall serve a single 12 year term, shy of being recalled by their nation, death, or voluntary resignation.    Terms shall be offset by 6 years.

Each Representation shall serve a single 4 year term, shy of being recalled by their nation, death, or voluntary resignation.  Terms shall be offset by 1 year.

Shall a congress person be recalled, die, or voluntarily resign, their nation may appoint a replacement to serve our the remaining portion of a term.  Such fractional terms shall be considered whole for purposes of term limits and as such partial terms used to initially establish both houses of congress.

Congress may not pass laws that primarily apply to themselves, their immediate family, staff, or business interest.  For any such conflict, a member of congress must recluse themselves from voting.

All members of congress must recuse themselves from all business interest they were engaged in prior to being appointed to office.

Compensation shall be paid to all members of congress at a rate of 75 percentile of the average of their nations average wage earning income.  The planetary government shall provide basic food, housing, and health care for members of congress during their terms.  

No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until two elections of Sentaors shall have intervened, beyond an annual adjustment based upon the average wage earning income.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Article 2 - Executive
Planetary President - check and balance role.

The planetary president shall have a term of 8 years, servable once in a lifetime.  

A Vice President may serve alongside the president and be elected to President for a total of 16 years of service, once in a lifetime.  The Vice President is appointed by the President and serves at the pleasure of the President.  The President may replace the Vice President anytime within the first 6 years of their term.

Should the President die or otherwise not be able to carry out their duties, the Vice President will be appointed as the acting President to serve out the President's term, or to serve until the  President can resume their duties.

The Vice President may appoint an Assistant Vice President for purposes of training with the intent on making such appointment their Vice President should the be elected to President.  

Should both the President and Vice President die or otherwise not be able to carry out their duties, the Assistant Vice President will be appointed as the acting President to serve out the original President's term, or to serve until the Original President can resume their duties.

All time served by the Vice President or Assistant Vice President as President will count toward their 8 year Presidental term limit.

The primary role of the President is to provide direction and prioritization to Congress, and to have Veto power over Congress.  A ninth tenths majority vote is required in both houses of Congress to override a Presidential veto.  

The President shall be elected by simple majority vote from a pool of Electors, with each member nation having one Elector.   Electors are appointed according to each member national internal preference, but  may not be the President, Vice President, Assistant Vice President, nor any member of Congress or their staff.  Should a tie occur, there will be a cycle of a one week pause followed by a revoting until a winner is determined.

Article 3 - Judicial
The judicial Power of the planetary government, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during legal Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.

The purpose of the Supreme Court is to ensure Constitutional principles are not being violated by any law created by Congress.

Article 4 - Nation Relations
The power of the 3 branches of government shall be limited to excommunication of violating nations from the planetary government for violation of sustainable processes and/or behavior.  At least 2 of the 3 branches must agree to such an act.

The total action allowed during excommunication shall be the total shunning of the violating nation from all planetary trade, planetary travel, planetary energy, planetary communication and other services enjoyed by members of the planetary government.  

No acts of violence may resourced by the planetary government against the violating nations territories under any circumstance.  Border defense and access to air, water, or land space beyond the countries territories are mandated.  Space based services must be restricted so as not to serve the violating nations geography.  Exceptions will only apply to the violating nations individual congress members who will be personally allowed to cross their border in order to participate in Congress - however said members will lose their voting privleges while their country is being shunned.  This exception is for the persons of Congress only and does not extend to any diplomatic or other staff of said person.

Lifting of excommunication will only occur when congressionally appointed representatives obtain a nine tenths agreement that the offending nation has ceased their violation and rectified any planetary damage incurred in their territory.

The President and members of planetary courts are subject under this article and shall be permanently removed from office should their nation of origin be excommunicated.

Artical 5 - Amendment
All amendments to this constitution shall require three fouths approval of both houses of Congress.  No such amendment shall remove or reduce the powers of either House of Congress nor the Presidency nor the judicial arm of the planetary government.

Artical 6 - Planetary Supremacy and Oaths of Office
This Constitution, and the Laws of the Planetary Government which shall be made in Pursuance thereof;  shall be the supreme Law of the Land; and the Judges in every member nation shall be bound thereby, any Thing in the Constitution or Laws of any Nation to the Contrary notwithstanding.

The Senators and Representatives before mentioned, and any members of the nations Legislatures, and all executive and judicial Officers, both of the Planetary Goivernment and of the member nations, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test nor requirement of a religious faith, nor race or sexual orientation shall ever be required as a Qualification to any Office or public Trust under the Planetary Government.

Article 7 - Ratification
The Ratification of the Conventions by nations representing 51% or more of the planetary landmass, shall be sufficient for the Establishment of the Constitution between the nations so ratifying the Same.

Article 8 - Armed forces
Congress shall establish a standing army for purposes of defending the members of the planetary government from aggression from non-member nations and/or excommunciated nations.  Said force is to have proportional representation from the member nations, optionally augmented by any forces from nations on the boarder of offending nations or within attack range thereof.

Actions of the armed forces are limited to those defined in Article 4 of this Constitution.

No member nation may deploy these forces against their own civilian population or against any other nation on the planet.

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

Article 9 - Reserved Powers
The powers not delegated to the Planetary Government by the Constitution, nor prohibited by it to the member nations, are reserved to the member nations respectively, or to the people.

Article 10 - Human Rights
It is not the preview of the Plantary Government to define how member nations govern themselves, beyond those controls defined by the Constitution and any laws passed by the Plantary Government.

Explicitly:  The Planetary Congress shall not pass laws governing:

1) Freedom of expression or religion (ref:  USA constitution Amendment 1)
2) Right to bear arms (ref: USA constitution Amendment 2)
3) Search and Seizure (ref:  USA constitution Amendment 4)
4) Rights of Persons (ref: USA constitution Amendment 5)
5) Rights of Accused in Crimnal Prosecutions (ref: USA constitution Amendment 6)
6) Civil Trials (ref:  USA constition Amendment 7)

nor any other nations constitional rights beyond those defined within this Constitution.
